The Magna Carta for Homeowners and Home Owner’s Associations, or otherwise known as the Republic Act Number 9904 is promulgated by the Housing and Land Use Regulatory Board (HLURB), implemented Rules and Regulations for the non-governmental, community based formed organizations such as for Home Owner’s Association. Home Owner’s Association is an organized association which is a non-stock, non-profit organization registered with the Housing and Land Use Regulatory Board. Home owner’s Association members are the owners or purchasers of a house and lot in a subdivision/village or other residential real property located within the jurisdiction of the association. The Board of directors or trustees of the association has the primary authority to manage the affairs of the association. The management and control of its affairs are distributed among themselves. Home owner’s Association officers are elected by its member home owners. Home Owner can also be an awardee and the legal occupant of a unit, house and/or lot. Every Home owner has the right to enjoy the amenities and facilities provided that the home owner pays the necessary fees like maintenance and services fees. Every Home owner must pay the necessary fees, charges pertaining to basic community services, and other special assessments such as but not limited to construction bond and stickers. A lessee of a member under a contract with a term of at least one (1) year may qualify to be a member and shall have the rights of a member upon procurement of a written consent or authorization from the owner of the lot or housing unit. A member in good standing shall have the right to avail and enjoy all basic community services and the use of common areas and facilities. Participate, vote and be eligible for any elective or appointive office of the association subject to the qualifications as provided for in the by-laws, participate in Home owner’s association meetings, elections and referenda, as long as bonafide member. Home owner’s association members duties includes payments of membership fees, dues and special assessments, to attend meetings of the associations and to support and participate in projects and activities of the association. Delinquent member is a member who has failed to pay three (3) cumulative monthly dues or membership fees, or other charges/assessment despite demands by the Home Owner’s Association. .
